Welcome to use AGGS game services! To safeguard your own rights and interests, please carefully read the specific terms and conditions before using the game software and related services provided by AGGS.
Please read and fully understand the contents of each clause of this agreement carefully, especially the clauses that exempt or limit the liability of AGGS (hereinafter referred to as the “exemption clauses”), the clauses that restrict the rights of users (hereinafter referred to as the “restriction clauses”), and the clauses that stipulate the dispute resolution methods and jurisdiction. The aforementioned disclaimer, limitation, dispute resolution methods and jurisdiction terms may be highlighted in bold, color-marked or other reasonable manner to draw your attention.
Unless you have read and accepted all the terms of this agreement, you have no right to use the AGGS game service. By clicking “Agree”, “Accept” or “Next”, or by registering and using the AGGS game service, you are deemed to have read and accepted all the contents of this agreement. Thereafter, you may not raise any form of defense on the grounds of not reading/not agreeing to the contents of this agreement or similar grounds.
If you are under the age of 18, please read this agreement under the accompaniment of your guardian and obtain the consent of your guardian, including all the terms of this agreement and your use of AGGS game services and payment of fees to AGGS, before using AGGS game services.
I. [Definition]
AGGS game software: It refers to the game software provided by AGGS that can run on mobile intelligent devices (including mobile games, etc.), as well as the updates, upgrades, patches, expansion packs, etc. of such game software, including the network servers, websites, forums or electronic documents related to such game software.
- AGGS Game Services: It refers to the game software provided by AGGS and all online operation services related to the game software.
- You, also known as “player” or “user”, refers to a natural person who has obtained authorization through legal means to use AGGS game software or receive AGGS game services.
Ii. [Scope of the Agreement - Contracting Parties: This agreement is jointly concluded by the user and the AGGS game service provider, Guangzhou Lingxi Interactive Entertainment Co., LTD. (hereinafter referred to as “AGGS”), and has legal effect.
- Supplementary Agreement: Due to the rapid development of the Internet industry, the terms listed in this agreement cannot fully list and cover all your rights and obligations with AGGS, and the existing agreements cannot guarantee that they will fully meet the needs of future development. Therefore, the “AGGS Account Service Terms”, “AGGS Privacy Policy”, game rules and their revised versions are all supplementary agreements to this agreement, inseparable from this agreement and having the same legal effect. If you use the AGGS game service, it is deemed that you agree to the above supplementary agreement.
- Modification of the Agreement: AGGS reserves the right to modify the terms of this agreement when necessary. You can review the latest version of the agreement terms on the relevant pages of AGGS. If you do not agree with the changes, you shall stop using the AGGS game service from the effective date when the changes are determined. If you continue to use the AGGS game service after the changes take effect, it will be deemed that you agree to the changes that have taken effect.
Iii. [Game Account
Before using AGGS game services, you must register an AGGS game account (hereinafter referred to as “user Account”) using your real identity information, mobile phone number or other third-party accounts recognized by AGGS (such as Alipay account, wechat account, QQ account, Weibo account, etc.). Users must provide their identity information for real-name registration and ensure that the personal information they provide is true, legal, accurate and valid. Users are not allowed to register with the identity information of others. If you use a third-party account recognized by AGGS as your game account, you should also abide by the relevant agreements and rules of that third-party account. - The user agrees that the personal registration information you provide will serve as the sole basis for AGGS to determine the connection between the user and the game account and to identify the user’s identity. Users are obligated to properly keep their user accounts and passwords and use them reasonably. AGGS will take reasonable technical and management measures to ensure the security of users’ accounts and passwords. If either party fails to fulfill the above obligations, resulting in the theft or loss of user accounts or passwords, and thereby causing damage to your or others’ civil rights, it shall bear the legal responsibility arising therefrom.
- If you find that your user account and password are abnormally logged in or illegally used by others, you should promptly notify AGGS to take necessary measures against your user account and password, including but not limited to suspending login and usage, freezing the consumption and transfer of virtual items in the account, etc. When AGGS takes restrictive measures against abnormal accounts as per your request, it has the right to ask you to provide and verify your valid personal information that is consistent with your registered personal information. If verified to be consistent, AGGS will take necessary restrictive measures based on your request or the specific circumstances. If you fail to provide valid personal identity information or proof consistent with the registered identity information, AGGS reserves the right to reject your request and shall not be liable for any losses caused to you as a result. If AGGS takes restrictive measures based on your request and causes losses to yourself or other users, you shall bear them yourself. Where the user provides valid personal identity information that meets the aforementioned requirements and AGGS fails to take restrictive measures in a timely manner, resulting in losses suffered by the user, AGGS shall bear the corresponding responsibility.
- For the security of your user account and password, please do not provide your user account and password to others for use (including but not limited to lending, renting, transferring, etc.). Otherwise, any adverse consequences arising therefrom (including but not limited to theft of account and password, loss of virtual items, and economic losses) shall be borne by you alone.
- If you do not log in to the game within 365 days, AGGS reserves the right to delete the user account and the game data under it. Once deleted, the data information cannot be recovered.
- AGGS games offer a “Visitor Mode” for users to log in to the game quickly. Users can log in to the game quickly without registering an account through convenient modes such as “Quick Play” and “Visitor Login”. You further understand and agree that you may not be able to make recharges or purchases in “Guest Mode”. Therefore, please bind your user account promptly after logging in. If you fail to bind your account in time, once you uninstall or reinstall the game, or if you replace your mobile phone, computer or other terminal devices, or if these terminal devices are damaged, all game-related data of you in this guest mode may be cleared and cannot be queried or restored.
Iv. [Game Software License]
Users can obtain AGGS game software from AGGS’s official website or from third parties authorized by AGGS. AGGS grants you a personal, non-commercial, non-exclusive, non-transferable and non-sublicenseable license in accordance with the terms of this agreement. You may download and install the AGGS game software on your device terminal within the scope of the license stipulated in this agreement and run the game software as directed by the software program. - Users can only use the AGGS game software for non-commercial purposes. Any commercial use without the permission of AGGS constitutes an infringement of AGGS’s rights.
- To ensure the security of the game software and optimize its functions, AGGS will update, modify or optimize the game software or some of its functions from time to time. After the release of the new version of the software, the old version may not be usable. Please update the game software to the latest version as soon as possible to avoid any usage restrictions.
s= V. [Game Services] - The user agrees that the charging items and standards for AGGS games and AGGS game services shall be determined by AGGS. If you wish to receive the corresponding services, you should pay the fees according to the charging items and standards determined by AGGS. If you do not pay the fees in accordance with the corresponding standards, you will not be able to enjoy the corresponding services. The specific charging items and standards will be announced on the Apple Store, Game Mall, purchase interface and other locations. Please read them carefully before purchasing. AGGS reserves the right to change or adjust the charging items and standards as needed. You shall not demand compensation or indemnity from AGGS due to changes or adjustments in the charging items or standards.
- AGGS has the right to issue game tokens in the game as needed. Game tokens are obtained by exchanging RMB and can be used to purchase, exchange game items, equipment, skins or other value-added services. Once RMB is exchanged for game tokens, it is regarded as the RMB having been used. Game tokens cannot be exchanged for RMB.
- Game props, game equipment, game tokens, etc. (hereinafter referred to as “game virtual items”) are part of the game service, and their ownership belongs to AGGS. Users have the right to obtain the right to use virtual items in the game, provided that they abide by this agreement and the specific game rules. All kinds of virtual items in the game, if there is no special indication of the usage period, are assumed to be usable by users until the corresponding game service is terminated. If the usage period is clearly marked, the usage period shall be based on the marked period. Except for force majeure or reasons attributable to AGGS, virtual items cannot be used after the expiration of their usage period.
- To better provide game services to users, AGGS may need to make adjustments to the content in the game. Such adjustments may involve the artistic appearance, skills and numerical Settings of the game characters, game equipment and other game props you are using. You understand and agree that such adjustments are the common practice in game operation, and you will not hold AGGS legally responsible for any such adjustments.
- All data and information generated by you during your use of AGGS game services (except for your name, ID number, phone number and other personal privacy data and information) are owned by AGGS, which has the right to store and manage them. AGGS will keep your records of virtual currency purchases in the game as required and provide channels and rules for you to query, modify or discard.
- There are objective situations where different operating systems are not interoperable, which may result in your account, game data and recharge records in one operating system not being shared with another. The risk of recharge loss and game data loss caused by your switching between different systems shall be borne by you alone. AGGS shall not be held responsible for this.
- In the game, there may be mandatory battle areas or gameplay modes. If you do not agree with mandatory battles, please do not enter that gameplay mode or game area. Once you click “Accept” or enter the mandatory battle area or gameplay, it will be regarded as your consent to the gameplay and acceptance of the battle result.
- Without the prior written permission of AGGS, you are not allowed to publicly record, display, copy, distribute or play all or part of the game content, graphics, etc. through third-party software, websites or platforms during the use of the game service.
- During your use of AGGS game services, there may be abnormal game data due to software bugs, version defects, third-party virus attacks or other factors. In the event of any abnormal data, AGGS will investigate the cause. During the investigation period, AGGS may need to freeze your game account or character. If the data anomaly is caused by abnormal gaming behavior, AGGS reserves the right to restore the game data to the state before the anomaly occurred.
- To ensure the normal operation of the game server, AGGS needs to regularly carry out shutdown maintenance on the game server or perform emergency shutdown maintenance in response to unexpected events. You understand and agree that you will not hold AGGS legally responsible for any interruption or suspension of normal services caused by the above circumstances. In necessary circumstances, AGGS reserves the right to terminate or partially terminate the operation of AGGS games at its own discretion and handle matters related to the termination of game operations in accordance with relevant regulations to safeguard the legitimate rights and interests of users.
Vi. [User Conduct Code] - Users are legally entitled to rights and responsible for the actions taken by their game accounts. You are not allowed to post the following prohibited content during the process of using AGGS game software and services
(1) Violating the basic principles established by the Constitution;
(2) Endangering national unity, sovereignty and territorial integrity;
(3) Leaking state secrets, endangering national security or damaging the honor and interests of the state;
(4) Inciting ethnic hatred or discrimination, undermining ethnic unity, or infringing upon ethnic customs and habits;
(5) Promoting cults or superstitions;
(6) Spreading rumors, disrupting social order and undermining social stability;
(7) Promoting pornography, obscenity, gambling, violence, or inciting criminal activities;
(8) Insulting or defaming others and infringing upon their legitimate rights and interests;
(9) Violating social morality;
(10) Other contents prohibited by laws, administrative regulations and national provisions. - Without the permission of AGGS or within the scope permitted by law, you shall not engage in the following behaviors:
(1) Reverse engineer, disassemble, decompile game software or attempt to obtain the source code of game software in other ways, or crack or modify the AGGS game software program;
(2) Producing, releasing, disseminating or using any form of cheating tools or programs that impede the fairness of the game, such cheating tools or programs may affect the game software or the data released into any terminal memory during the software’s operation, the interaction data between the client and the server during the software’s operation, as well as the system data necessary for the software’s operation To copy, modify, add, delete, run or create any derivative works, to modify the functions or operation effects of the software, including but not limited to add-ons, plugins, unauthorized third-party software, systems, etc.
Due to the characteristics of cheats and other cheating tools such as their concealment or disappearance after use, you understand and agree that the monitoring data in the game program will be used as the basis for determining whether you have used cheating tools.
(3) Using external software such as network accelerators and AIDS, robot programs or game synchronizers, etc. to maliciously damage service facilities, disrupt normal service order, and affect the balance and fairness of the game;
(4) By privately setting up game servers or other means, providing others with services that are exactly the same as or similar to AGGS game services, regardless of whether it is for commercial purposes;
(5) Scan, explore and test game software to detect, discover and find possible vulnerabilities and errors (bugs), or take advantage of program vulnerabilities and errors (bugs) to disrupt the normal operation of the game and seek improper benefits, or spread game program vulnerabilities or errors (bugs);
(6) Attacking or intruding into the AGGS game software server or the AGGS Company website server, causing server overload and affecting the normal operation of the server;
(7) Using, renting, lending, copying, modifying, linking, reprinting, compiling, publishing, or publishing the game software and all or part of its contents beyond the scope authorized by this agreement;
(8) Modify, cover up or delete the name, company logo, trademark, copyright information, intellectual property statement, service source and other contents of the game software program;
(9) Other acts not expressly authorized by AGGS. - During your use of AGGS game services, you must not engage in the following improper gaming behaviors:
(1) Publishing or spreading illegal remarks or inappropriate information, including but not limited to Posting indecent remarks, spam advertisements, promoting cheats, viruses, proxy playing, offline transactions and other information in the game;
(2) Using content involving, but not limited to, race/religion, politics, national leaders, pornography/vulgarity, defamation/intimidation, aggression, insult, possible misunderstanding, prohibited drugs, drugs, etc. as account nicknames, character names, or names of in-game groups or organizations.
(3) Stealing others’ game accounts, game virtual items, and players’ personal information, and assisting account thieves in operating and transferring game virtual items, etc. Purchase or obtain for free game accounts obtained by others through account theft.
